These Terms and Conditions (“Terms”) govern the use of our website, resources, courses, and examinations. By using our services, you agree to these Terms. Please read them carefully.
1. General
- “We”, “Us”, “Our” refers to BMH Training Limited.
- “You”, “Your” refers to any learner, customer, or website user.
- These Terms include our Privacy Policy and supersede all previous versions.
- We may update these Terms at any time; the version on our website at the time of your booking applies.
- English law applies, with jurisdiction in the courts of England and Wales (unless you are resident in Scotland or Northern Ireland, where local courts may also apply).
2. Intellectual Property
- All resources, documents, courses, and materials on this website are protected by copyright.
- They are licensed only for personal educational use and may not be copied, scanned, photographed, uploaded, or redistributed online or offline without written consent.
- Tutors may use materials in lessons but must direct learners to our website for access.
- Uploading or sharing our resources on social media or other platforms is strictly prohibited.
3. Orders, Deliveries and Certificates
- Resources purchased are supplied electronically unless otherwise stated.
- Certificates are posted once issued by the awarding body. Our selected courier is Royal Mail. We are not responsible for delays caused by postal services, particularly during peak times such as Christmas.
- If customers provide incorrect details (e.g. wrong postal address), we are not liable for non-delivery. We will assist where possible, but replacement costs may apply.
4. Courses
- Course access is valid for 12 months from the date of purchase.
- Once a course has been accessed, no refunds are available.
- If you cancel within 14 days without accessing the course, we will refund your payment minus a £15 administration fee.
5. Examinations
Booking
- Exams are booked through our website. A user account will be created for exam administration.
- Professional invigilators oversee examinations; their instructions must be followed. Failure to comply may result in your exam being voided by the awarding body.
Cancellations
- Within 14 days of booking:
- Mathematics: £65 if registration has been submitted to the awarding body (covers registration and cancellation costs).
- English: £20 per element (Reading, Writing) and £30 for Speaking and Listening if registration is complete (reflects registration, administration and cancellation costs).
- If registration has not been submitted, £10 administration fee.
- If a reschedule has already occurred: £15 to cover additional administration.
- Mathematics resits will be charged a £10 administration fee unless a reschedule has already occurred, at which time there will be a £15 administration fee.
- English resits will be charged a £10 administration fee per element, unless a reschedule has already occured, at which time there will be a £15 administration fee.
- After 14 days: No refund, as awarding body and invigilation costs will already have been committed.
- Speaking & Listening: Once the assessment brief has been issued, this is considered the start of the exam, and no cancellations are possible.
Rescheduling
- More than 48 hours before the exam:
- First reschedule: free.
- Second reschedule: £10.
- Third and subsequent: £20 each.
- Within 48 hours before the exam:
- First reschedule: £20.
- Further reschedules: £30 each.
- Speaking & Listening: cannot be rescheduled once the assessment brief has been issued, as other learners depend on your participation.
Technical Issues
- If an exam cannot go ahead due to an unsuitable internet connection, hardware, or other learner-side technical issues, the exam may be rebooked for a £20 administration fee.
- No refund is available in these circumstances.
Appeals
- Learners may appeal exam results for a £68 administration fee.
- Appeals may take up to 25 working days to be processed.
- Outcomes are determined by the awarding body, and marks can go up or down.
- Discounted resits are not available where an appeal is unsuccessful, unless the awarded grade is within 5% of the pass mark.
6. Liability and Warranty
- While we take care to ensure materials are accurate and accessible, we do not guarantee that the website or resources will be uninterrupted or error-free.
- We are not liable for exam results, delays in marking, or certificate issuance caused by awarding bodies.
- We are not liable for losses due to postal delays, third-party services, or learner technology issues.
- Website use is at your own risk; we are not responsible for viruses, malware, or other harmful content.
7. Complaints
- Complaints will be acknowledged within 7 working days and responded to within 28 working days.
- Escalated complaints should be submitted in writing to: directors@bmhtraining.co.uk
- If a complaint cannot be resolved, we may advise discontinuing use of our services.
- Complaints relating to third-party services (e.g. tutors, delivery providers) should be directed to the relevant organisation.
8. Contact
- Notices may be sent by email or post.
- Email notices are deemed received on the day sent (or next working day if sent on a weekend or holiday).
- Postal notices are deemed received three working days after posting.
